Students of the Trisaki proposal of the Act on the Criminal Procedure Act set forced pickup Compulsory permit PN



Jakarta (Antara) – Student organizations of the Faculty of Rights, Trisaksi University suggests that the action of forced Pick -Up carried out by researchers against suspects or witnesses must obtain permission from the chairman of the Local Court (PN), which must be included in the revision of the Criminal Procedure or the Criminal Code.

The student representative of Trisakti University, Wildan Arif Husen, said it must be regulated to protect the rights for citizens. Because in practice he was of the opinion that someone who was picked up by force was not necessarily a suspect automatically.

“Maybe a little effort in practice, because it may be too long in terms of administration, but we also see in terms of our rights or rights of citizens,” said Wildan during a hearing at the House of Representatives Commission III in parliament Complex, Jakarta, Wednesday.

He explained, in the existing Bill Draft, forced pick -up could be done if the suspect or witness who mentioned did not enter the investigation. Moreover, researchers can also pick up violence if the suspect or witness avoids the investigation.

However, he suggested that in Article 30 there was an additional article in the bill of the criminal proceedings of the Criminal Code.

“It is also aimed at maintaining judicial control and also repressive actions that are often carried out by parties, especially law enforcement officers to students,” he said.

Moreover, he said that the proposal was to guarantee that the actions of researchers, in particular in the research process, such as search, confiscation, forced pick -up, should take into account the principles of protection of witnesses and victims.

“Dissecations, confiscation or forced efforts in the form of pickups that often do not match working hours,” he said.
