Bandung (Antara) – Deputy Minister of Primary and Secondary Education (Wamendikdasmen) Atip Latipulhayat revealed the exemption from education costs as imposed by the decision of the Constitutional Court (MK) will probably be carried out in the next school year (2026), not this year.
“Even if it is performed, I think it is quite heavy if it is implemented this year, because the tax year is performed halfway,” said ATIP on the Upi Bandung campus on Monday.
The decision of the Constitutional Court to free the costs of education, both public and private schools, is not only a matter of eliminating without aspects of financing, taking into account the fact that everything is closely related to the focus of the budget.
“We are currently coordinating with the relevant ministries to see the possibility of budget assignment. The point indeed depends on the budget,” he said.
ATIP also said that so far technical regulations or technical guidelines have not yet existed when implementing the policy.
“The technical is not yet available. For the implementation we still have to do calculations first,” he added.

Earlier, the Constitutional Court decided that in this case the State had to eliminate the central and regional governments primary education in the Elementary, Junior High and Madrasa Education Units of Equivalent, both in public and in private schools.
“In view of the applicant’s request for a part,” suhartoyo sued court said the number 3/PUU-XXII/2024 on the MK RI, Jakarta, Tuesday (6/27).
The Constitutional Court stated that the expression “at least compulsory education at the level of primary education without collecting reimbursements” in Article 34 paragraph (2) of Act 20 of 2003 on the National Education System (Sisdiknas) led to several interpretations and discriminatory treatment, so that it is contrary to the constitution of the republic.
Constitutional judge Enny Nurbaningsih explained that the expression “compulsory education at a minimum level of primary education without collecting reimbursements” whose application only applies to public schools can lead to gaps for primary schools who go to private schools.
Moreover, in certain circumstances there are students who are forced to visit private schools due to a limited capacity of public schools.
In such conditions, according to the Constitutional Court, the State still has constitutional obligations to ensure that no students are impeded to get primary education only because of economic factors and limited primary education facilities.
